Terms of Service

1. Agreement to Terms

By accessing or using the Accountium platform at https://accountium.io or any associated mobile or desktop application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users, including individuals, businesses, and organizations that access the Service on behalf of a company.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using Accountium, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

3. Account Registration

To access most features, you must create an account. You agree to:

  • Provide accurate, complete, and current information during registration.
  • Keep your login credentials confidential and not share them with others.
  • Notify us immediately at office@accountium.io if you suspect unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

4. Subscription and Payment

4.1 Plans and billing

Accountium offers paid subscription plans. By selecting a plan, you authorize us to charge your chosen payment method on a recurring basis (monthly or annually, depending on your selection). All fees are in Canadian dollars unless otherwise stated.

4.2 Free trial

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid plan unless you cancel before the trial expires.

4.3 Refunds

All payments are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us within 14 days of the charge.

4.4 Price changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price change takes effect for existing subscribers.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Process, store, or transmit fraudulent or illegal financial data.
  • Upload malicious code, viruses, or any harmful software.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Scrape, reverse-engineer, or copy any portion of the Service without our written consent.
  • Use the Service to provide competing services to third parties without prior written agreement.

6. Your Data

You retain ownership of all financial data, files, and content you upload or create within the Service ("Your Data"). By using the Service, you grant Accountium a limited, non-exclusive license to store, process, and display Your Data solely to provide the Service to you.

We will not sell, rent, or share Your Data with third parties except as described in our Privacy Policy.

7. Intellectual Property

The Service, including all software, designs, text, graphics, and logos, is owned by Accountium and protected by Canadian and international intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.

8. Availability and Uptime

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance that temporarily affects availability. We will make reasonable efforts to notify users of planned downtime in advance.

9. Termination

9.1 By you

You may cancel your account at any time from your account settings or by contacting us at office@accountium.io. Cancellation takes effect at the end of your current billing period.

9.2 By us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. In cases of serious violations, we may terminate immediately without notice.

Upon termination, your right to use the Service ceases. You may request an export of Your Data within 30 days of termination, after which we may delete it.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Accountium does not warrant that the Service will be error-free or that any financial calculations or reports generated by the Service are accurate for tax or legal purposes. You are solely responsible for verifying the accuracy of your financial data.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Accountium and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business — arising out of your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in British Columbia, Canada.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
